Terms and Conditions

1. Overview:
These Terms & Conditions (“Terms”) govern your access to and use of the Gingerbread Helpers website and any related pages, content, products, and services (collectively, the “Services”).

Gingerbread Helpers is operated by Contacto Logístico, S.A., Guatemala (“we,” “us,” “our”), and may also be operated by any successor or affiliated entity that operates the brand in the future. By visiting or purchasing from our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

2. Eligibility:

You must be at least the age of majority in your place of residence to purchase from our Services.

3. Products & Descriptions:

We offer digital products (printable gingerbread templates, PDF guides, and related files) and may also offer physical products (such as the Gingerbread Helpers Toolkit tin and accessories).

We make every effort to accurately describe and display products. However, colors and appearance may vary depending on your device and settings. Product descriptions and availability may change at any time without notice.

4. Orders, Pricing & Payment:

By placing an order, you make an offer to purchase. We reserve the right to accept, decline, or cancel any order in our discretion (including due to suspected fraud or unauthorized activity).

Prices may change without notice. You agree to provide current, complete, and accurate purchase information.

Payments are processed through third-party payment providers (e.g., Stripe). We do not store full payment card details.

5. Digital Products: Delivery & Access:

Digital products are delivered electronically, typically immediately after purchase via download link and/or email.

You are responsible for ensuring you enter the correct email address at checkout and for downloading and saving your files.

If you experience technical issues accessing your files, contact us and we will help you regain access when possible.

6. Refunds & Returns:

A. Digital Products (Templates / PDFs):
Because digital files are delivered instantly, all digital sales are final and refunds are not offered once delivery is made. If you have trouble accessing your files, we will support you.

B.  Physical Products (if applicable):

Return and shipping terms for physical products are governed by the specific policy provided at time of purchase (and/or the marketplace listing where purchased). Additional shipping fees, customs, and taxes may apply for international deliveries.

If you purchase physical products through a third-party marketplace (such as Etsy), that purchase is governed by the marketplace checkout terms and the policies shown on that listing at the time of purchase.

7. License & Permitted Use (Digital Templates):

When you purchase a Gingerbread Helpers digital template, you are purchasing a personal-use license, not ownership of the design.

You may:

  • Print the files for your personal, non-commercial use
  • Build gingerbread projects for personal enjoyment and display
  • Reprint for your own future personal use

You may not (without written permission):

  • Use any part of the files for commercial purposes
  • Trace, modify, remake, or create derivative templates for resale
  • Use the files to create products for sale, including “template-based” services
  • Include files in kits, classes, workshops, communities, memberships, or paid events
  • Upload the files to shared drives, groups, forums, or file-sharing platforms• Share, sell, sublicense, gift, or redistribute the files (digitally or physically)

Commercial use is not permitted. If you need licensing for commercial use, contact us.

8. Intellectual Property:
All content on the Services—including templates, diagrams, written guides, photos, videos, text, graphics, and branding—is owned by or licensed to Gingerbread Helpers and is protected by intellectual property laws.

No part of the Services may be copied, reproduced, distributed, or exploited for commercial purposes without our prior written permission.

9. Custom Orders (Edible Builds):

Gingerbread Helpers may offer custom gingerbread builds or edible display pieces (“Custom Orders”).

Order Confirmation & Approval
Custom Orders are made to order based on specifications agreed upon between you and us. You are responsible for reviewing and approving design details, spelling, sizing, and event dates before production begins.

Payment & Refunds

A Custom Order is not confirmed until payment (or required deposit) is received.

Due to the personalized nature of Custom Orders, all Custom Orders are final sale and non-refundable once production has begun.

Perishability & Structural Nature
Gingerbread structures are handcrafted edible products and may be affected by humidity, temperature, transportation, handling, and environmental conditions. We are not responsible for structural damage, melting, cracking, or shifting that occurs after pickup or delivery.

Pickup, Delivery & Risk Transfer
Risk of loss transfers to you upon pickup or delivery. You are responsible for safe transport, storage, and display conditions after transfer.

Food Safety & Allergens
Our products may contain or come into contact with common allergens, including but not limited to wheat, dairy, eggs, and nuts. It is your responsibility to inform guests of potential allergens. You agree to notify us in advance of any specific allergy concerns. We cannot guarantee an allergen-free environment unless expressly stated.

If applicable under local law, products may be prepared in a home kitchen that is not inspected by a regulatory authority.

Event Timing
While we make reasonable efforts to meet agreed timelines, we are not responsible for delays caused by events beyond our control, including weather, supply shortages, illness, or force majeure events.

10. Workshops & Events (In-Person and Virtual):

We may offer in-person workshops, virtual workshops, and instructional sessions (“Workshops”).

Registration & Payment
Workshop registration is not confirmed until payment is received. Workshop fees are non-refundable unless otherwise stated. In certain cases, transfers to a future workshop may be permitted at our discretion.

Assumption of Risk (In-Person Workshops)
Participation in in-person Workshops involves the use of baking tools, cutters, icing equipment, and edible materials. By attending, you voluntarily assume all risks associated with participation, including minor injuries such as cuts, burns, or allergic reactions.

You agree to follow all safety instructions provided during the Workshop.

Food & Allergens

Workshop materials may contain or come into contact with common allergens. You are responsible for informing us in advance of any allergies. We cannot guarantee an allergen-free environment unless expressly stated.

Health & Safety Compliance
Participants must follow all venue rules and safety instructions. We reserve the right to remove any participant whose behavior is disruptive or unsafe, without refund.

Virtual Workshops
For virtual Workshops, you are responsible for obtaining your own materials, equipment, and internet access unless otherwise stated. We do not guarantee specific creative results, as outcomes depend on individual skill, materials, and environment.

Photography & Recording
We may photograph or record portions of Workshops for promotional or educational purposes. By attending, you grant permission for the use of images or recordings that may include your likeness, unless you notify us in writing prior to the event.

11. Prohibited Uses:

You agree not to:

  • Use the Services for unlawful purposes
  • Attempt to bypass security or payment systems
  • Copy, scrape, or harvest content from the site
  • Use our content to train AI models or build datasets without permission
  • Misrepresent your affiliation with Gingerbread Helpers
  • Infringe our intellectual property or that of others

We may restrict or terminate access for violations.

12. Third-Party Services & Links:
The Services may include links or tools provided by third parties. We are not responsible for third-party content, policies, or services. Your use of third-party sites is at your own risk.

13. Feedback:

If you submit ideas, suggestions, reviews, or feedback, you grant us a worldwide, royalty-free permission to use it to improve and promote our Services. You confirm you have the right to submit it.

14. Disclaimers:

The Services and products are provided “as is” and “as available.” We do not guarantee uninterrupted access or that the Services will be error-free.

We are not responsible for results related to baking, structural outcomes, or build quality, which depend on materials, environment, tools, and individual technique.  You are responsible for safe food handling, storage, and structural stability during construction and display.

(Some jurisdictions do not allow certain warranty limitations; in those cases, limitations apply to the fullest extent permitted by law.)

15. Limitation of Liability:

To the fullest extent permitted by law, Gingerbread Helpers and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products.

Our total liability for any claim will not exceed the amount you paid to us for the product giving rise to the claim.

16. Indemnification:

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Services, violation of these Terms, or infringement of intellectual property rights.

17. Electronic Communications:

By using the Services, you consent to receive communications electronically and agree that electronic notices and records satisfy legal requirements for written communication.

18. Governing Law:

These Terms are governed by the laws of Guatemala, and disputes will be handled in the courts of Guatemala City, Guatemala, unless otherwise required by applicable law.

19. Changes to These Terms:

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Services indicates acceptance.
